The Consequences of Sexual Battery

Sexual battery is defined as non-consensual vaginal, oral, or anal contact with a sexual organ or an object. Per Florida Statutes Title XLVI § 794.011, there are degrees of sexual battery charges and associated punishments. These punishments also depend on aggravating circumstances and the ages of the victim and the offender. Any person, even a minor, convicted of sexual battery in Florida will be designated as a sexual offender for life.

  • Lewd or Lascivious Molestation by an Adult on a child under 12:

      • Minimum 25 years in prison
      • Lifetime sex offender probation with fines
  • Lewd or Lascivious Molestation by an Adult on a child 12 or older, but younger than 16:
      • Second degree felony
      • Up to 15 years in prison
      • Up to 15 years of sex offender probation with fines
  • Lewd or Lascivious Molestation by a Minor on a child under 12:
      • Second degree felony
      • Up to 15 years in prison
      • Up to 15 years of sex offender probation with fines
  • Lewd or Lascivious Molestation by a Minor on a child 12 or older, but younger than 16:
      • Third degree felony
      • Up to 5 years in prison
      • Up to 5 years of sex offender probation with fines
