What Is Street Racing?

According to Florida statute 316.191, it is illegal for a person to participate in a speed competition on a public highway, roadway, or parking lot. The law defines such matches as races, acceleration contests, tests of physical endurance, exhibitions of speed, and drag races.

Specifically, individuals are prohibited from:

• • Driving a vehicle in a race competition
  • Coordinating, facilitating, collecting money for, or in any other way knowingly participating in a race
  • Knowingly riding as a passenger in a vehicle involved in a speed competition

The law applies not only to cars, but also to trucks, vans, motorcycles, and off-road vehicles such as dirt bikes and ATVs.

What Are the Penalties for Street Racing?

Street racing is a first-degree misdemeanor.

A conviction for a first offense carries the following penalties:

• • Up to 1 year in jail
  • Up to $1,000 in fines
  • Up to 1 year driver’s license revocation

If a person is convicted for a second time within 5 years of the previous, they could be subject to:

• • Up to 1 year in jail
  • Up to $3,000 in fines
  • Up to 2 years driver’s license revocation

A third and subsequent conviction within 5 years could result in the following penalties:

• • Up to 1 year in jail
  • Up to $5,000 in fines
  • Up to 4 years driver’s license revocation

On top of the jail time, fines, and loss of driving privileges, the vehicle could be impounded for up to 30 days. If it is the second or subsequent conviction within 5 years, the vehicle could be seized and forfeited.
